Rule 78D
Provisions relating to complaints

(1) Civil servants who are not satisfied with the evaluations made by supervisors and reviewers during performance evaluation, Section 24A of the Act. When complaining according to sub-section (6D) of the concerned reviewer, the complaint can be filed before an officer one grade above. But the following employees should file a complaint with the following officer:-
(a) Chairman of the Public Service Commission or a member of the commission designated by him in case of a gazetted special category or first category employee other than the Nepal Justice Service, (b) Chairman of the Judicial Service Commission or a member of the commission appointed by him, if he is a gazetted special category or first category employee of the Nepal Justice Service. (2) If a complaint is received according to sub-rule (1), the officer hearing the complaint shall make a decision within fifteen days after making the necessary investigation and shall inform the petitioner and the review committee.
(3) When making a decision according to sub-rule (3), the officer who hears the complaint may maintain the score given by the supervisor or reviewer or amend the score and give a different score.
(4) In case of revision of marks according to sub-rule (3), the revised marks shall be considered as the marks given by the supervisor or reviewer.
